These Terms of Use describe the services offered by us and form a contract between you, the user, and DoMyResume.NET (Do My Resume, L.L.C., an Arizona limited liability company). BY USING THE SITE AND/OR OUR SERVICES, USERS AGREE TO BE BOUND BY THESE TERMS OF USE. Please read them carefully, as any use of this Site constitutes an agreement to be bound thereby.

Section I — Definitions & Agreement to be Bound

1.1 Definitions

Dispute means any claim or controversy arising from these terms.

Material Breach means a breach serious enough to warrant immediate termination.

Services includes resumes, cover letters, LinkedIn profile overhauls, reference lists, thank you letters, headshots, CVs, federal resumes, and interview coaching.

Site refers to www.domyresume.net and related DoMyResume.NET branded websites.

DoMyResume.NET means Do My Resume, L.L.C., an Arizona limited liability company.

1.2 Agreement to be Bound

Users must be at least 18 years old to use this Site or Services. By accessing the Site you confirm you have read, understood, and agree to be bound by these Terms of Use.

Section II — General Provisions

2.1 No Guarantee of Employment & Interviews

We do not guarantee that any user shall find employment leads, interviews, or positions from our services. Success is dependent on the user's own commitment to their job search and on meeting or exceeding employer requirements. No income or sales figures should be construed as promises or guarantees of future success.

2.2 Accuracy, Completeness, and Timeliness of Information

We are not responsible if information made available on the Site or via the Services is not accurate, complete, or current.

2.3 Errors in Web Site and/or Services

We do not warrant that any errors in the Site and/or the Services will be corrected.

2.4 Modifications and Changes to Terms of Use

We may modify, add to, suspend, or delete these Terms of Use at any time, with such modifications being immediately effective upon their posting to the Site.

2.5 Modifications and Changes to the Web Site and Services

We reserve the right to modify, suspend, or discontinue any aspect of the Site or Services at any time without notice or liability.

2.6 Access to Site and Services

While we attempt to maintain 24/7 availability, we do not warrant uninterrupted access. Your device may not support all aspects of the platform.

2.7 Right of Refusal, Limitation, Discontinuation, and Termination

Users have up to 90 days from the date of payment to utilize any and all services. After 90 days, the user forfeits any and all deposits, funds, and/or payments. Multiple writers may handle one user's work due to timing or quality considerations.

2.8 Prohibited Uses of Site and Services

Users may not use the Site for unlawful purposes, to violate any laws, to infringe intellectual property rights, to harass others, to submit false information, to upload malicious code, to engage in spamming, or to engage in any form of discrimination.

2.9 Customer Service

Hours: Monday through Friday 7 a.m. to 9 p.m. and Saturday through Sunday 8 a.m. to 6 p.m. Arizona time.

2.10 External Accounts

In some cases we may review employment accounts (LinkedIn, Indeed, etc.) that require your username and password. We recommend changing your password and security questions after service completion. We are not liable for unauthorized access or consequences from account changes made by staff.

Section III — Service Fees

3.1 Service Fee

Fees are pre-paid via credit or debit card at amounts specified on the Site.

3.2 Refunds

Due to the nature of the Services, in no event shall a refund of a pre-paid Service Fee be granted, including but not limited to errors in the Services, dissatisfaction with the Services, or failure to obtain interviews or employment.

3.3 Revisions

Users may request reasonable revisions twice to any work product arising from the Services, within thirty (30) calendar days following the first delivery of drafts.

3.4 Guaranteed Interviews Within 45 Days Or Less

We guarantee interviews within 45 days if clients meet all of the following conditions: applying to 10 or more positions daily (5 days per week), having the required qualifications for applied positions, and applying to positions tailored to their background. Clients must provide proof of compliance and claim the guarantee within 65 days. If conditions are met, we will provide a free resume review and revision. The guarantee does not apply where insufficient job postings exist in the client's field.

Section IV — Intellectual Property

4.1 Intellectual Property Rights Not Waived

The Site and Services are protected by U.S. and international intellectual property laws. All materials are owned by the company or its licensors. Users may not copy, reproduce, publish, modify, distribute, or commercially exploit any materials. A single personal, non-commercial print copy is permitted provided copyright notices are not removed. Users acquire no rights beyond limited site use as described in these Terms.

4.2 Feedback

Any feedback you submit grants us sole ownership and the right to use, modify, distribute, and create derivative works without compensation or notice. You waive any moral rights to submitted content.

Section V — Third-Party Advertisements, Promotions, and Links

5.1 Third Party Advertisements and Promotions

We are not responsible for dealings with third-party advertisers or losses resulting from those interactions.

5.2 Use of Third-Party Tools

Third-party tools are provided “as is” without warranties or endorsement. Users assume all risk from their use.

5.3 Third-Party Links, Products, and Services

We provide documents in MS Word and Adobe formats, subject to change. We are not responsible for third-party content, accuracy, or transactions.

5.4 Grant of License

We receive an unrestricted, perpetual worldwide license to use your de-identified work product for promotional materials without compensation or further permission.

Section VI — Disclaimers; Limitations of Liability; Indemnification

6.1 Disclaimer of Warranty; Limitation of Liability

The Site and Services are provided “AS IS” without warranties of any kind. IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO ANY INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, OR OTHER DAMAGES. Our total liability is limited to the greater of (A) the Service Fees paid by you in the twelve (12) months prior to the claim, or (B) $100.

6.2 Indemnification

You agree to defend, indemnify, and hold us harmless from any claims arising from your actions, breaches of these Terms, use of third-party services, or unauthorized account use.

Section VII — Governing Law; Arbitration

7.1 Governing Law

These Terms are governed by the laws of the State of Arizona. Jurisdiction is the courts of Maricopa County, Arizona.

7.2 Arbitration

All disputes are resolved exclusively through binding arbitration in Maricopa County, Arizona under American Arbitration Association rules and Arizona law.

Section VIII — Miscellaneous

8.1 Affiliate Disclosure: We may earn commissions from third-party affiliate products and services.

8.2 Different and Conflicting Terms: We reserve the right to negotiate different terms with individual users.

8.3 Authority: Both parties represent they have full authority to enter into this agreement.

8.4 Waiver: Waivers must be in writing. Non-exercise of a right does not constitute a waiver.

8.5 Force Majeure: We are not liable for delays from acts of God, natural disasters, war, government actions, or strikes.

8.6 Assignment: We may assign rights to third parties with notice. You may not assign your rights without our written consent.

8.7 Relationship and Severability: The parties are independent contractors. If any provision is found invalid, the remaining terms stay in full effect.
